ONLINE PURCHASE CONDITIONS

Please read the following online purchase conditions carefully before making transactions on this website. By making any purchase on the Nanö Collection online store (“Nanö Collection” or “we”) you (“the client”) accept the conditions hereafter.

OUR PRODUCTS

Even though we have made every effort to display our products in the most accurate manner possible, we cannot guarantee that the colours displayed on your screen will appear as they should. However, the product description and material list will provide some guidance when selecting our products.

Product availability

Should one or several of the products you ordered be no longer available, a member of our online store staff will contact you by email as soon as possible. If they are not able to reach you by email, we will try to reach you by phone. If we do not contact you regarding availability, then your complete order will be sent to you according to the shipping method selected during the ordering process.

Pricing

All prices are subject to change without prior notice. Purchased items will be charged based on the prices displayed at checkout.

Limitations

We reserve the right to cancel any order made on our website. At our own discretion, we may limit or cancel the quantities of items ordered by one person or household, or in a single order. Should we change or cancel your order, we will contact you at the telephone number provided during the ordering process. We reserve the right to limit or decline orders that we deem were made by merchants, resellers or distributors, or were put through while experiencing a technical issue.

ONLINE ORDER DELIVERY

Shipping costs

Standard shipping fees and handling fees for orders under 100 CAD$ before taxes are 20.00 CAD$ and free for orders over 100 CAD$ before taxes.

A flat shipping rate of $7.00 applies to all standard orders. Shipping costs for a single order that requires multiple parcels will be invoiced only once.

Nanö Collection cannot guarantee that different orders to be sent to a same address will be shipped together. It is the client's sole responsibility to combine their purchases if they do not wish to pay the shipping costs for each order.

Nanö Collection reserves the right to refuse to ship an order if the actual shipping costs are greatly higher than the fee charged to the client. Should that be the case, Nanö Collection will contact the client to discuss the available options or simply refund the order directly.

Delivery times

Deliveries usually take from 5 to 10 business days (Monday to Friday, public holidays not included). Please allow up to 12 business days for deliveries in remote locations.

Nanö Collection shall not be held responsible for longer delivery times due to issues or errors made by the third-party carrier (e.g. an error at the Canada Post sorting facilities).

Risk of loss and transfer of ownership

All the items purchased through the website are subject to a shipping contract in which we assume the risk of loss of the items ordered from the moment we hand them to the carrier. The ownership titles of the items are only transferred to you once you take procession of the parcel at its destination (i.e. at the delivery address you provided during the ordering process or at the Canada Post counter), as the delivery date confirmed by Canada Post will testify.

In the event of an exchange or return of items by mail, we will assume the risk of loss of such items from the moment you hand them to Canada Post, provided that you follow the directions described in the Exchanges, returns and refunds section below. The ownership titles of those items will then be transferred to Nanö Collection as soon as Canada Post takes possession of the parcel. Should the client not follow the directions provided in the Exchanges, returns and refunds section below, the client will assume the risk of loss until Nanö Collection receives the parcel.

Carrier

Shipping in the United States:
Shipping is available in all states of the United States. Carrying of the product(s) in Canada is handled by Canada Post and the product is transferred to United States Postal Services “USPS” at the American border, who will take over the shipping and handling process of the product(s) for all the United States territory.

Shipping in Canada:
Shipping and handling is taken care of by Canada Post.

The carrier carries out all order deliveries throughout Canada. Canada Post will deliver the parcel at the post office that is closest to your delivery address should no one be available to receive the parcel at that address. A Delivery Notice will be left at your door, providing you with the necessary information to collect your parcel. No signature will be required if the delivery is made at the address you provided during the ordering process, but you will need to produce a valid photo ID to collect the parcel at the post office.

SNOWSUIT WARRANTY

Damages on snowsuits or major ready-to-wear items resulting from a manufacturing defect are guaranteed, provided that you notify us in the 60 days following the reception of the order. Only manufacturing defects are covered by this warranty and Nanö Collection reserves the right to decline warranty claims at any time should we deem that the damages in question were not caused by a manufacturing defect.

PAYMENT METHODS

All payments are made through PayPal. During the ordering process, you will be redirected directly to the secured PayPal website, where your payment will be preauthorized. Please note that we do not have access to any electronic data pertaining to the credit information provided during PayPal transactions. The only information to which we have access is the the outcome of the transaction.

Should some or all of the items ordered online be unavailable, we will deduct the amount equivalent to the value of the unavailable products from the order total before proceeding to the final authorization of the transaction.

Invoicing

We will send an invoice to the email address provided during the ordering process. Each invoice comes with a summary of our online purchase conditions. Another copy will also be included with your parcel.

Taxes

Customers from United States
No sales tax will be applied on any order shipped to the United States.

Customers from Canada
The taxes applied to every order are compliant with the federal and provincial laws on applicable taxes in the province or territory of the delivery address provided during the ordering process. As required, taxes will also be applied to the shipping and handling fees.

If you return an item for a refund, the taxes paid for such item will also be refunded. However, taxes paid on shipping and handling fees will not be refunded, as such fees are not refundable once the parcel has been sent.

*Please note that according to the legislation (GI-063) in some provinces, the harmonized sales tax (HST) cannot be applied to children's clothing, but only on shipping fees. HST is not applied in the following provinces:
- PRINCE EDWARD ISLAND
- NOVA SCOTIA

EXCHANGES, RETURNS and REFUNDS

Order changes or cancellations

If you wish to change or cancel your order after your transaction is completed, you must notify us as soon possible by email at webservice@nanocollection.com or by phone at 418-878-9555, ext. 21. We will make every effort possible to accommodate you. However, we are not able to change or cancel an order that has already been handed to the carrier.

Please note that if you cancel the order of an item that has made you eligible to a promotion, a special rebate or a free delivery, you will no longer be entitled to such benefit.

Exchanges and returns by mail

Following reception, items purchased on our online store can be exchanged within 30 days or returned within 15 days, provided that they are returned to Nanö Collection in their original state, i.e. not washed, not worn, not altered, with the original price tag still on and in its original packaging.

Nanö Collection will refund or replace any defective item free of charge, provided that the item is returned in its original packaging and along with the corresponding delivery slip in the 15 business days following reception. Nanö Collection will cover the return shipping fees for any defective item. The replacement item will be shipped free of charge.

To request an exchange or refund, you must send us an email describing the item and the reasons for the exchange or refund. Nanö Collection will then send you an email containing a return label and details regarding the delivery of the replacement item. Please print the return label and fix it to the return parcel. Then, drop the parcel at your local post office. Nanö Collection will not refund your return shipping fees if you do not follow the above return procedure.

In the case of an exchange, we will only contact you if the replacement item requested is no longer available. Otherwise, that item will be promptly shipped free of charge. If the price of the replacement item is lower than that of the original item, we will credit the difference back to the client upon the reception of the returned merchandise using the original payment method. However, if the price of the replacement item is higher than that of the original item, we will ask you to provide the necessary information to proceed to the payment of the difference.

Returns and exchanges (swimsuits only)

Swimsuit returns and exchanges, whether online or in-store, will only be accepted if the items still have their original price tag on and their hygienic liner is still intact.
